Legal Regulatory Approaches for Minors’ Use of AI-Assisted Learning

Abstract: With the rapid integration of artificial intelligence in educational technology, AI-aided learning has become ubiquitous among minors. Such systems offer personalized instruction and real-time feedback, but at the same time, bring legal risks concerning children’s personal data, algorithmic bias, content safety, and the weakening of meaningful consent. This article uses a doctrinal and comparative legal analysis to explore the regulatory challenges of minors using AI-assisted learning tools, and makes the case that current legal frameworks are fragmented and reactive, thus ill-equipped to deal with the particular vulnerabilities of child learners in algorithmic spaces. The article proposes an hybrid, rights-based, regulatory pathway of age-appropriate design obligations, improved data governance and algorithmic transparency, schools duties and multi-stakeholders co-regulation. By aligning the legal risks and the applicable regulatory measures in a systematic map, the article offers a road map to the legislative, educational and platforms actors willing to protect minors without hindering the educational promises of AI.
